On December 3, 2021, the NVAC filed NG-12/3/21 (Flu Vaccine Mandate) over the Department’s failure to satisfy national bargaining obligations over the implementation of a flu vaccine mandate.
Last month, VISN 21 leadership notified AFGE Locals that it was implementing the flu vaccine mandate. The notice provided that the vaccine was a condition of employment, and that bargaining unit employees would be required to provide documentation that proved either that they had received the vaccine, or that they had applied for a medical or religious exemption. The notice further stated that a failure to comply could result in discipline.
Notification was only provided to VISN 21 Locals; but since the level of recognition is national, the Department was required to provide notice and an opportunity to bargain to the NVAC.
