On December 6, 2021, the NVAC filed a national grievance against the Department for its failure to comply with the Voluntary Requests for Reassignment provision contained in Article 13, Section 4 of the Master Agreement. Specifically, the NVAC is aware that certain local management officials are refusing to allow reassignments under this provision and are instead forcing bargaining unit employees to apply for open vacancies. By failing to grant voluntary requests for reassignment, the Department has violated Articles 2, 3 and 13 of the MCBA and committed an unfair labor practice by repudiating the MCBA.

To remedy the Department’s violations, the Union is seeking remedial training for the responsible management officials, an electronic notice posting acknowledging its unfair labor practice, an order that it comply with the Master Agreement, and make-whole relief for any impacted bargaining unit employee by granting outstanding voluntary reassignment requests.
